These terms govern your use of the Total Form Fitness app and website ("the Service"), provided by Total Form Fitness, Scarsdale, New York ("TFF", "we", "us"). By creating an account you agree to them: the sign-up screen asks you to confirm that you are 16 or older and agree to these terms and the Privacy Policy, and we record when you agreed and to which version.
1. Who can use the Service
You must be at least 16 years old and able to agree to these terms. You are responsible for keeping your sign-in details private and for activity on your account.
2. Fitness coaching, not medical advice
The Service provides fitness coaching. It is not medical advice and does not diagnose, treat or prevent any condition. Check with a doctor before starting a new program, especially if you have an injury, a medical condition or pain. Stop exercising and tell your coach if anything hurts. You exercise at your own risk, and you are responsible for giving us accurate health information.
3. Programs and AI
Programs, meal estimates and progress notes may be generated with AI and reviewed by your coach. They are guidance, not guarantees of results. Tell your coach if a program does not suit you.
4. Your content
You keep ownership of what you add — intake answers, logs, messages, photographs and clips. You give TFF permission to store and use it to provide the Service to you, as described in our Privacy Policy. Do not upload anything unlawful, or content that belongs to someone else without permission.
5. Acceptable use
Do not misuse the Service: no attempts to reach other people's data, disrupt the Service, reverse engineer it, or use it to harass anyone, including coaches.
6. Reporting, and what we do about it
Every message the other person sends has a Report underneath it. A report goes to the studio and never to the person you reported. You can also block the person you are talking to, from the same sheet; we are told when you do, so we can sort out your coaching.
We read every report. Depending on what we find we may warn the person, move you to a different coach, or close an account. We keep a report even if the account it came from is later deleted, because it is a record of what happened.
7. Payments
Nothing is sold inside the app. There is no purchase, no subscription and no payment screen in it. Coaching is arranged and paid for with the studio directly, and those arrangements are between you and TFF, not part of the Service.
8. Ending your account
You can delete your account at any time in the app (Profile → Delete Account). We may suspend or close an account that breaks these terms, with notice where reasonable.
9. Availability and changes
We work to keep the Service available but cannot promise it will always be uninterrupted or error-free. We may change or discontinue features. If we change these terms materially, we will tell you in the app before the change takes effect.
10. Warranties and liability
The Service is provided as it is. Beyond the warranties the law gives you and does not let us exclude, we do not promise that it will be uninterrupted, error-free, or fit for a particular purpose.
To the extent the law allows, TFF is not liable for indirect, incidental or consequential losses. Our total liability to you for any claim arising out of or relating to the Service is limited to the greater of one hundred US dollars ($100) or the amount you paid TFF through the Service in the twelve months before the claim arose.
Nothing in these terms limits liability that the law does not allow to be limited. Training at the studio is covered by the agreement you sign there, not by these terms — this section is about the app.
11. Governing law, and how a dispute gets resolved
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
Please read this section carefully. It changes how a dispute between us is decided, and it limits the way you can bring a claim.
Talk to us first. Almost everything is settled by writing to info@totalformfitness.com, and we ask you to do that before starting anything formal. We will do the same before we start anything against you.
Arbitration. If that does not settle it, you and TFF agree that any dispute arising out of or relating to these terms or the Service will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration takes place in Westchester County, New York, or by telephone or video if you would rather. The arbitrator decides the dispute, and judgment on the award may be entered in any court that has jurisdiction.
No class actions. You and TFF may each bring claims only on your own behalf, and not as a plaintiff or a class member in any class, consolidated or representative action. An arbitrator may not combine more than one person's claims.
You can opt out, and you have 30 days. If you do not want to be bound by the arbitration agreement or the class-action waiver, email info@totalformfitness.com within 30 days of first agreeing to these terms, giving your name and the email address on your account, and say that you are opting out. It costs you nothing, and nothing else about your account changes. If you opt out, disputes go to the state or federal courts in Westchester County, New York, and you and TFF each agree to the jurisdiction of those courts.
Small claims is always open. Either of us may bring an individual claim in small claims court instead, and nothing in this section prevents that.
12. Apple
These terms are between you and Total Form Fitness, not Apple, and Apple is not responsible for the app or its contents. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price; to the maximum extent the law allows, Apple has no other warranty obligation, and any other claim arising from the app is ours to answer, not Apple's. TFF, not Apple, is responsible for addressing any claim that the app or your use of it infringes someone's intellectual property. You confirm you are not in a country subject to a US embargo or listed by the US government as prohibited, and you will comply with any third-party terms that apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
